USCIS Releases Advance Copy Of Notice On Provisional Unlawful Presence Waivers
USCIS released an advance copy of the Federal Register notice of the final rule to allow certain immediate relatives of U.S. citizens who are physically present in the U.S. to request provisional unlawful presence waivers prior to departing from the U.S. for consular processing. Changes from the proposed rule include allowing individuals in removal proceedings to file if the case has been administratively closed and not recalendared at the time of filing the I-601A, and allowing someone whose application has been denied or withdrawn to file a new application.
TRAC Reports 25% Decrease in Filing of NTAs in Court Over Last Year
This Transactional Records Access Clearinghouse (TRAC) report shows that during November 2012, the government reported 14,926 new ICE filings seeking deportation orders, which is down 24.8 percent from levels in FY2012.
