Sometimes, individuals or family members who are in the United States, legally or as undocumented aliens, are placed in deportation or removal proceedings. There are three agencies, which may have jurisdiction or input into a deportation hearing or removal proceeding:

The procedures for determining whether an alien is to be removed from the United States are set forth in the Immigration and Nationality Act (“INA) and corresponding regulations. The procedure used in a given case depends on the individual’s circumstances.

Some individuals are not entitled to a hearing before an immigration judge and may be ordered removed by an immigration enforcement officer. Most aliens, however, are entitled to an on-the-record hearing before an immigration judge, who is authorized to grant applications for relief and protection from removal.
